JOIN US for this important 8-hour workshop Presented by one of the leading Silica compliance specialists in the country, Michael Peelish of The Law Office of Adele L. Abrams PC.  We have designed this workshop with specific content and deliverables to help you achieve your compliance requirements, better understand this new rule, and industries role and responsibilities.  We have also invited our colleagues in ICAPA, OCAPA & AGC to attend.

This Silica Training is primarily for Sand & Gravel and AGC members regulated under the OSHA Silica Standard for General Industry, 29 CFR 1910.1053.  However, the presentation/training will meet the standards for competent person under the OSHA Silica Standard for Construction Industry, 29 CFR 1926.1153.  The recommended training approach is to cover the materials in one 8-hour training session and follow-up with members on a scheduled basis via a WACA Webinar series to address specific issues or needs of our members if desired.

• In March 2016, OSHA published its long-awaited final rule establishing a stand- alone standard governing occupational exposure to respirable crystalline silica in construction, general industry and maritime workplaces.  It was confirmed by the D.C. Circuit Court of Appeals in December 2017.
• Crystalline silica is found in many construction materials, including brick and mortar, concrete, slate, granite, engineered stone products, tile, asphalt materials, plastic composites, soil, wallboard joint compounds, paint, plaster, caulking and putty. It is also generated when silica, containing materials are milled, cut or crushed, or when building demolition occurs.  
• OSHA’s new rule on crystalline silica requires construction employers to limit worker exposure to silica and take steps to protect workers. General Industry employers  regulated under 29CFR 1910.1053 must comply with all requirements of the standard by June 23, 2018.

Michael Peelish, Senior Attorney - Law Office of Adele L. Abrams P.C.
Michael holds a degree in engineering of mines and has over 26 years working in the mining industry with both metal/nonmetal and coal operations. He received his engineering of mines and law degree from W. Va. Univ. His experience includes litigated cases before the MSHA Review Commission and in state and federal courts. Throughout his career, he has worked with mine and OSHA facility operators to implement safety and health programs, to audit operations against their safety and health programs, to conduct property insurance inspections, and to seek improved ways of protecting employees’ safety and health.  Mr. Peelish has been involved in developing exposure control plans and programs to assist companies in complying with all aspects of the respirable crystalline silica final standard and will explain how to develop and implement an important written exposure control plan (WECP) in a productive and efficient manner.

The DESIRED OUTCOME as a result of this training, is for attendees to be confident in implementing a Silica Exposure Control Program and to be able to develop Written Exposure Control Plans (WECP) for individual tasks.

• The most common tasks that generate high exposures to respirable crystalline 
• Engineering controls, work practices, and respiratory protection that effectively protects workers at high-risk for respirable crystalline silica exposure under Table 1 
• Who must measure silica exposures to verify levels are at or below the permissible exposure level (PEL) for workers—and under what circumstances a company is exempt from permissible exposure level or monitoring exposure requirements 
• Tips for evaluating whether to use the equipment/control options in Table 1 or alternative exposure control methods

Competent Person: OSHA's Construction Standard for Respirable Crystalline Silica

A Competent Person is someone who has the knowledge to identify and the foresight to anticipate respirable crystalline silica hazards in the workplace.  This is a high threshold of knowledge and understanding of the hazards associated with and the tasks that give rise to respirable crystalline silica.  

Having this understanding and knowledge will allow you to deliver training to other persons to make them competent. They gain the skills to ensure implementation of the written exposure control plan, take the actions necessary, and ensure exposure to respirable crystalline silica is minimized in the workplace. 

This “Train-the-Trainer Competent Person” portion will:

• address the universe of knowledge required to be a Competent Person.  
• provide the resources for trainers to continuously deliver training to multiple persons and job sites.  
• address the basic content of the silica standard;
• Identify health hazards, how to implement Table 1, how to handle non-Table 1 tasks,
• when and how to conduct exposure monitoring, preparation of a written exposure control plan,
• what exposure and medical surveillance documentation must be maintained,
• what to look for on a job site to ensure compliance with the silica rule, and how to manage the job site’s multiple contractors.
